How to File a Real Estate Lien in North Dakota
- 1). Go to the North Dakota secretary of state's website (nd.gov/sos) and select Form UCC-1A under the link for "Lien Information." Print the form and review it, collecting all of the necessary information that's asked for before you begin completing it.
- 2). Complete Form UCC-1A, providing all of the required information. (Bear in mind that North Dakota requires Form UCC-1A to be typed instead of handwritten.) The form asks for the full name, address and contact information of the debtor; the full name, address and contact information of the secured party; the type of property that's being covered; the description of the collateral; and a full legal description of the transaction.
- 3). Review the form carefully to ensure that all information is accurate and is spelled correctly. Once filed, Form UCC-1A represents a legal document binding two parties to a lien, so it's essential to ensure that there are no errors in the wording or spelling.
- 4). File the completed document with the Office of the County Recorder. Submit Form UCC-1A to the county recorder for the county in which the original real-estate transaction is recorded. (This will probably be the same county in which the property is located.) If you're unsure of where the county recorder is located, consult the North Dakota Recorders Information Network to locate the this office.
- 5). Pay the required fees for Form UCC-1A. These fees include an original filing fee, a recording fee, a satisfaction fee and a fee for any additional pages that are added to the provided form. North Dakota law requires the fee to be paid at the time of filing, so be prepared to pay (with cash or a check) when you submit the document for filing and recording. There's also a termination fee for Form UCC-1A, so when the lien ceases to be in effect, the parties must pay a fee to terminate the agreement.
