  • You always have the right to challenge foreclosure in court. In a judicial foreclosure state, your lender has to go before a judge to foreclose. When you're notified of the hearing, you can file a response with the court to ensure the judge will hear your side of the case. In a nonjudicial state, lenders don't have to go to court, but you can file yourself to bring the case before a judge. If you don't have good legal grounds for stopping foreclosure, however, a court fight may cost more time and money than it's worth.
