How to File a Motion to Convert to Chapter 7

    • 1). Confirm that you have not previously converted your bankruptcy case. According to the U.S. Bankruptcy Code, you may only convert a bankruptcy case once. Thus, if you originally filed for Chapter 7 bankruptcy and then converted to another chapter, you cannot convert your case again.

    • 2). Fill out a means test form and evaluate your eligibility for Chapter 7. A means test form allows the bankruptcy court to compare your current income for your household size to the state average. If your income level is equal to or lower than the state average, you qualify to file under Chapter 7.

    • 3). Pick up a Chapter 7 bankruptcy petition from the bankruptcy court. Fill out all of the paperwork regarding your current debts, assets and income.

    • 4). Fill out a Notice of Conversion. Have your current bankruptcy case number available, as you will need to supply it to the court on your motion to convert.

    • 5). Return the means test form, Chapter 7 petition and Notice of Conversion to the bankruptcy court where you originally filed your Chapter 13 case.

    • 6). Pay the filing fee to convert your case. Although most bankruptcy filing fees are static, the fee to convert may vary depending on your court district.

    • 7). Wait for the court to notify you of whether or not it approves of your conversion request.
