Kansas Laws Regarding Cell Phone Use in an Automobile

      The state of Kansas is one of 28 states (as of 2010) that has passed some type of ban that affects how drivers may use cell phones while behind the wheel of an automobile. Kansas enforces all cell phone laws as primary laws and not secondary laws. Using the primary law, an officer in Kansas does not need any other reason to stop the driver of the car when the officer sees someone driving and using the cell phone in a capacity that the state has banned.

    Handheld Ban

    • The state of Kansas does not have a handheld ban in place. An officer cannot stop or cite a driver for talking on a handheld device while behind the wheel.

    No Cell Phone Ban

    • The state of Kansas has a no cell phone ban for novice drivers. Novice drivers include those with a learner's permit or with an intermediate license. Under the Kansas no cell phone ban if a police officer cites a novice driver for using a cell phone while behind the wheel, the driver will incur a $60 fine (as of 2010) and the possibility of a suspended license.

    Text Messaging Ban

    • The governor of Kansas passed a law in 2010 that prohibits all drivers regardless of age from reading, writing or sending a text message while driving an automobile. Although the law passed in 2010 police officers could not legally act on the law until January 2011.
