How to File a Motion in Colorado

    Hard Copy Filing

    • 1). Visit the office of the clerk for the Colorado Court in your county.

    • 2). Present the clerk with at least two forms of current personal identification -- a driver's license and Social Security card, for example. Explain your situation and ask the clerk for an official motion form.

    • 3). Complete the form in full. Describe in detail why the motion is necessary in the prefabricated text box. Copy and include any and all substantiating documents -- medical and financial records or police reports -- to validate your claim. Make three copies of the form and all substantiating documents.

    • 4). Return two copies to the clerk -- one for court records and the other for the defendant. Keep the third set of copies for your records. Pay any filing fees associated with your motion.

    Electronic Filing

    • 1). Go online and visit the U.S. District Court for the District of Colorado website. Click the "Forms" link and download the motion form that suits your needs. Fill out and save the form.

    • 2). Scan and save any substantiating supporting evidence you have into your computer.

    • 3). Write an email to newcases@cod.uscourts.gov. Enter the words "New Motion" into the subject line. Include the case name or number in the subject line, if you already have one.

    • 4). Address the email to the "Court Clerk." State in one or two sentences that you are filing a motion via electronic format and that your documents are attached. Mention how you are paying your filing fee -- via check or money order, payable to "Clerk, U.S. District" or debit or credit card. Include your full name and contact information at the bottom.

    • 5). Send the email. Follow up with the court after three days. Send checks or money orders via standard mail or pay with credit or debit card at the District Court House.
