How to Fill Out a FISA Warrant
- 1). State "In the matter of the search of," followed by the name and address of the subject of the search or wiretap. There's not a single official preprinted form specific to FISA courts, although you can use other federal search warrant applications as a template for guidance (see Resources).
- 2). State your name, position and agency affiliation.
- 3). Provide a background of the case and the suspect. FISA courts are secret, so you can openly discuss classified or sensitive information in the warrant (indeed, given the nature and purpose of such warrants, it would be difficult not to).
- 4). Detail specifically your reasons for requesting authorization for a search or wiretap. You must convince the judge that such constitutionally sensitive measures involve vital national security interests.
- 5). Specify the locations, means and time frame of the search or surveillance. FISA courts can approve mobile phone warrants that permit surveillance of not just a single phone (to account for the abundance of communications technology in a digital age). Detail the evidence you expect to recover as a result of the search or wiretap.
- 6). Sign and date the form at the bottom.
