Child Endangerment from a Meth Lab results in First Ever Criminal Case

Howden Saggers Solicitor, Kristie Doyle, and Barrister Tracy Mossop (specialising in Criminal Law) initially resisted charges for child endangerment from a home-made meth lab set up by their client.  When Police & Child Safety later obtained court orders for hair samples from the client's children, and had such samples forensically tested, proving Meth amphetamine exposure, the matter unavoidably ended up in the Supreme Court as a guilty plea.

In the first ever such decision in Queensland, and seemingly Australia, His Honour Justice Daubney considered the Prosecutor's submission of 2 ½ to 3 years jail with parole after 10 to 12 months for the Production offences, and 10 to 12 months also being a jail term just for the 5 Endangerment offences.  The Judge ultimately accepted Defence Counsel Tracy Mossop's submission of 2 years jail with parole fixed after 8 months, and 8 months jail for the Endangerment offences.

This is a landmark case that required research and a determination as to how any existing legal cases pertaining to child abuse under State Laws might assist the court. The end penalty result was not just a good one for the client, but sets a good precedent for any person facing guilt for such an offence in the future.
