    Five Primary Factors in Sentencing

    • Five factors apply in most cases to sentencing procedures under Section 142: the impact of the punishment on the offenders, whether the punishment will reduce crime elsewhere, the reform and rehabilitation of the offender, the protection of the public and the process of reparation to those harmed by the offender.

    Where the Five Factors Do Not Apply

    • The five factors do not apply or only partially apply to convicts under the age of 18, for certain firearms sentences, offenders who require special oversight due to mental illnesses or offenders who are considered extremely dangerous under the specifications found in Sections 225 and 228 of the Criminal Justice Act.

    • More specific guidelines for how courts calibrate the five factors are given by the Sentencing Council of England and Wales.
