Drugs law in malaysia
Dangerous Drugs Act 1952 is the primary statue in Malaysia on drugs control in Malaysia. It is based on punitive approach which punish heavily any person who involves in drugs related crime in Malaysia. However, it is still remain a question whether Malaysia can be a drug free nation with this approach. Dangerous Drugs Act 1952 must be amended and revised with confinement approach. Comparative studies should be made with anti drugs law in Portugal and Netherland.
Prisons in Malaysia currently hold 36,040 people with at least 16 other detention centres are in place with close to 40% of the prison inmates were imprison on drug-related charges, representing over 16,000 individuals. Malaysian goverment had declare war against drugs for almost 30 years and recent statistics clearly does not show the government is winning the war.
Greater risk on drugs trafficking created a black market which is mainly controlled by crime syndicates who gain hefty profits on the drugs. Large amount of profits gain by those drug dealers will encourage them to bribe the law enforcement officials to avoid being caught and prosecuted under Dangerous Drugs Act 1952. Kevin John Barlow and Brian Geoffrey Chambers were hanged in Malaysia in 1986 for trafficking five ounces of heroin. Malaysia clearly is known in the drugs dealing world as a country with a strict no drug policy.
In 1999, Portugal have one of the highest HIV and AIDS rate in the European Union. Their goverment decided to take an experiment with their drugs law in order to curb with their drug problems. In 2009, a research on those experiment had shown Portugal drugs related crime had reduced to almost 50%.
This clearly had shown the success of the experiment although many critics claims at the first that their decriminalisation of drugs will create more drugs related crimes and make Portugal as a drugs vacation country due to their approach in drugs. Decriminalisation should not be confused with legalisation. Decriminalisation means drugs is still illegal but will be punishable with administration one rather than criminal.
Maybe Malaysian government should adopt Portugal approach in drugs in order to win in these drugs war. Criminals make a lot of money dealing in drugs thus creating gang wars in fighting for control of drugs territory.
Cannabis user always have their talk on legalisation and they always try to compare cannabis with alcohol and cigarattes. Support and claims have been made through research made by universities in cannabis benefits. Cancer and diabetes had been proven to be cured or prevent by use of cannabis. I always believe that God created everything for a reason and things made by God is the best. One may ask himself by asking wether banning or saying cannabis is harmful is like saying God had made a mistake. Cannabis use can be trace to ancient china in medical field. It also had been use by certain religion as a symbol of peace and mind relaxing. A wise man once said to me that an anger man is a happy man without cannabis.
