DIY Last Will & Testament
- 1). Download and print a will form to help guide you through the writing process. An example is available in the resources below.
- 2). Title the document “Last Will & Testament of [Your Name].” Beneath the title, write the date you executed the will and write a sentence further declaring the document to be your will.
- 3). Break the will into sections and title each section. This makes the will easy to read. Section 1 could be titled “Personal Representative.” Section 2 could be called "Gifts." You can add as many or as few sections as you choose.
- 4). Appoint a personal representative (also called an “executor”). This person is responsible for administering your estate when you pass away and if possible should be an independent person such as an attorney.
- 5). Dispose of your property by listing the each item and explaining who it goes to. If you wish to give your watch to your grandson Ned, you might write: “To my grandson Ned, I give my gold wristwatch that can be found either on my person or on my dresser.” Note that you can give away “all” of your property to one individual by writing “I give to [person’s name] all my personal property and tangible effects.”
- 6). Bring the will to a notary public. Bring two witnesses with you. Sign the will in the presence of the witnesses and the notary. Have each witness sign the will. Have the notary notarize the will. While notarizing the will is not required in all states, it is always a good idea. Place the completed will in a safe place, such as in a safe deposit box, and inform the executor of its whereabouts. If feasible, provide the executor with a copy of the will.
